Prevention

Everyone has heard the adage, “an ounce of prevention is worth a pound of cure,” a quote attributed to Benjamin Franklin in 1735 encouraging planning and action to help prevent fires from devastating growing cities. As with fires, not all disputes and lawsuits can be prevented, but many can often be avoided and many more, if not most, resolved much more favorably (and at a fraction of the cost) by simple preventive measures.

Tom helps clients be proactive in protecting their rights and interests at the most critical time — before they enter into or alter major legal relationships, contracts and transactions in areas such as:

  • the construction of a home or commercial building
  • business partnerships
  • buying a business
  • employment agreements.

Whether a short conference or more involved consultation, contract review, contract preparation, or other assistance is needed, Tom offers to help clients both prevent trouble down the road and increase the probability the transaction/relationship is a positive and rewarding one.

Resolution

There are things in life that improve with age. Unfortunately, a legal dispute is rarely one of them. To protect yourself, when a legal dispute or issue arises, it is important to make sure you understand the legal rights and obligations involved. Delaying action or acting without a full understanding of one’s legal rights can result in the complete loss of those rights and, at other times, a resolution that is much less favorable, more costly and more time-consuming.

Tom helps ensure that clients who are involved in a legal dispute understand important legal rights and interests related to their dispute. At times, this can be accomplished with a short consultation and nothing more is needed. When additional assistance is required and desired, Tom works with clients to develop and implement a solution to the legal issue or dispute by:

  • assisting the client to resolve the dispute themselves
  • communicating on behalf of the client, and negotiating a favorable resolution — both informally and through pre-suit mediation.

With each approach, the objective is the same: an effective, favorable, cost-efficient and timely resolution to a legal dispute that resolves a lawsuit before it starts.

Litigation

Tom’s primary practice involves representing clients in state and federal court lawsuits and arbitration proceedings. Although the initial objective is to help clients prevent and otherwise resolve legal disputes outside of court, not all disputes can be prevented or resolved without a lawsuit.

Tom represents individuals, businesses and organizations who need to file a lawsuit to enforce and protect their legal rights, or who are named in a lawsuit filed by another. In pursuing or defending against claims for monetary damages or enforcement of other legal rights, Tom provides one-on-one attention, focused, in part, on:

  • Listening to you — to understand not only the facts pertinent to your matter, but also your concerns and objectives
  • Advocating for you — serving as a strong advocate for your rights and interests both in and outside of court
  • Problem-solving — Tom’s extensive experience and knowledge can lead to creative, effective solutions that are not obvious to the parties involved
